Conditiile platii compensatiei financiare pentru concediile anuale platite neefectuate in momentul incetarii raportului de munca

Posibilitatea compensarii zilelor de concediu neefectuate a aparut in dreptul intern in urma transpunerii Directivei 2003/88/CE privind anumite aspecte ale organizarii timpului de lucru ("Directiva") care stipuleaza la art. 7 alin. (2) faptul ca perioada minima de concediu anual platit poate fi inlocuita cu o indemnizatie financiara doar in cazul in care relatia de munca inceteaza.

In Romania, Codul Muncii a preluat aceasta prevedere stipulata la art. 146 alin. (3) prin care reglementeaza faptul ca zilele de concediu neefectuate vor fi compensate doar in cazul in care inceteaza raporturile de munca. Citeste continuarea aici.
