SEMINAR DE BUNE PRACTICI IN LEGISLATIA MUNCII | 09 MAI 2023
Un nou Seminar de Bune Practici in Aplicarea Legislatiei Muncii va avea loc ONLINE pe 09 mai 2023, intre orele 15:00 - 17:25. Vor fi dezbatute trei subiecte de mare interes pentru comunitatea noastra, iar la finalul fiecarei sesiuni vom aloca 15 minute pentru intrebari punctuale pe temele sustinute de speakerii evenimentului.
Pentru o cat mai buna documentare a raspunsurilor, va incurajam sa ne trimiteti in avans intrebarile pe temele propuse, iar pentru a reusi sa raspundem tuturor, va rugam ca numarul acestora sa fie de maxim 3 per companie.

Vom discuta despre prevederile propunerii de Directiva europeana aprobat de Parlamentul European la data de 30 martie 2023 si impactul pe care aceasta directiva l-ar putea avea asupra pietei muncii din Romania, avand in vedere noile obligatii cu privire la transparenaa sistemului de salarizare care ar reveni angajatorilor.
Prevenirea și combaterea discriminării și hărțuirii la locul de muncă au generat interes ridicat în ultimii ani, interes accelerat și de contextul digitalizării relațiilor de muncă.
Comportamentele care pot constitui fenomene nedorite în relațiile de muncă devin din ce în ce mai variate, iar gestionarea lor de către echipele de HR și Legal ridică provocări suplimentare. Pentru a nu se expune unor riscuri legale, angajatorii trebuie să manifeste o atenție sporită pentru identificarea, prevenirea și combaterea acestor comportamente.
Pentru a veni în sprijinul angajatorilor, prezentarea Filip & Company va sumariza reglementările legale aplicabile, caracterizate de paralelism și ambiguitate, și va aborda principalele obligații care le revin companiilor, precum și măsurile pe care le pot implementa pentru prevenirea și combaterea discriminării și hărțuirii la locul de muncă.
Persoanele care au relatii de serviciu au cadrul legal sa raporteze incalcari ale legii beneficiind de masuri de protectie. Angajatorii cu peste 50 de angajati au obligatia sa creeze cadrul intern care sa asigure in principal posibilitatea de raportare si masurile de protectie.
In cadrul prezentarii, ne propunem sa trecem in revista obligatiile angajatorilor in materie si modalitatea in care aceste obligatii se reflecta asupra departamentului de resurse umane.
Speakers
Mihai ANGHEL este Partener în cadrul departamentului de dreptul muncii al Țuca Zbârcea & Asociații, oferind consultanță unor companii din diverse sectoare ale industriei, precum FMCG, farma, transporturi, IT&C, imobiliare, financiar-bancar, telecomunicații etc.
Cu o experiență juridică de 19 ani, activitatea lui Mihai acoperă toate aspectele relevante legate de dreptul muncii, de la angajare și concediere, discriminare și hărțuire, evaluări ale performanței, remunerații și beneficii, până la aspecte legate de relația cu sindicatele și contracte colective de muncă, transferul de întreprinderi transfrontaliere, proiecte complexe de outsourcing/insourcing, chestiuni legate de imigrație, detașări transfrontaliere etc.
Mihai este membru HR Club și European Employment Lawyers’ Association (EELA).
Cristina joined Filip & Company immediately after her bar admission, back in October 2013. During her career, she gained extensive expertise in both legal consultancy and dispute resolution, including international arbitration.
Cristina’s main specialization is employment law, field in which Cristina holds a master’s degree from the Faculty of Law, University of Bucharest, and in which she is now undertaking her PhD studies, the main research theme being “The effects of transfers of undertakings, units or parts thereof on the employment relationships (critical analysis of the national and European legislation and jurisprudence)”. In the academic field, Cristina is also conducting seminars on Labour Law for the students in the fourth year at the Faculty of Law, University of Bucharest.
In the consultancy area, Cristina is assisting clients active in various industries (e.g., energy, IT/ tech, banking and financial sector, FMCG pharma, electronics/ appliances, cosmetics producers/ distributor, retail), some of the core and recurrent topics in her activity covering: major restructurings projects, assistance with the employment side in M&A transactions, TUPE restrictions, collective negotiations, collective litigations with unions, requalification of civil contracts with contractors, individual negotiations for termination cases or managing sensitive situations with top management.
In the litigation field, Cristina coordinated cases that reached notorious successes for our clients, privately or publicly owned, saving hundreds of millions of EUR for the companies represented in court. In addition to the employment litigation, Cristina manages fiscal and administrative proceedings, commercial cases (including disputes among shareholders or arising out of SPAs) or civil files (e.g. urbanism related issues).
Highlights of her activity include assisting:
- one of the largest telecom operators on the Romanian market in an international arbitration seated in Vienna under the VIAC Rules, in a dispute concerning a claim for indemnity regarding certain matters related to the sale of its subsidiary in the Czech Republic;
- a major provider in the energy field in a series of labour litigations initiated by the trade union (in the name of over 3,000 employees) in relation to the application of the compensation scheme regulated by the collective bargaining agreement (the stake of these litigations is around EUR 100 million);
- a world leading business consultancy firm in a complex litigation opened by a former senior partner, involving the requalification of that relationship as an employment relation and direct accusations against other members of the firm.
Ioan co-heads the Commercial department of our firm. He is primarily involved in employment, data privacy, restructuring & insolvency and M&A projects. He also gained extensive experience in private equity, real estate, energy, IT projects and banking. Ioan assisted clients concluding successful projects in a variety of industries among which IT, retail, food & consumer goods, pharma, automotive, energy, oil, telecom or agriculture.
Highlights of his activity include assisting:
- complex restructurings of major players in the automotive, packaging or pharmaceutical industries, including workforce optimization, reorganization of grading and pay systems;
- in reshaping labour relationships and collective negotiations for companies active in FMCG, IT, automotive, food industry;
- clients before various authorities and regulators in inspections, controls or in view of obtaining certain authorisations or opinions;
- clients in negotiations with key employees during conflicting situations;
- complex corporate restructuring processes of several limited liability companies active in the agricultural field, as well as potential management buy-out of two of these companies;
- the largest platform of extra-salary benefits for employees in Romania in its acquisition by Edenred, the world leader in prepaid service vouchers, during all the stages of the process;
- a Romanian entrepreneur in relation to the acquisition of a Romanian company active in the postal services by the Austrian Post. Assistance included negotiation and signing of complex transaction documents and post signing assistance with completing conditions precedent.
Dan has wide experience in providing legal advice to both local and multinational companies. His main areas of expertise are corporate and commercial law, mergers and acquisitions, intellectual property, commercial litigation, and sport law.
Dan regularly participates as speaker at conferences and seminars open to the general public or specialists, on matters such as commercial law, sports law and GDPR.
Since Nov 2022 Dan is a Member of the Commission of Appeal on preventing and combating doping in sport (General Secretariat of the Government). Starting with April 1st, 2021, Dan has been appointed by Sport Resolutions to the International Panel of Arbitrators and Mediators for the period of three years. He is a member of the Disciplinary Panel for the Romanian Tennis Federation, since 2022. In December 2021, Dan became an arbitrator for the Permanent Court of Arbitration within AHK Romania. Between 2019-2022 Dan was also a member of the Appeal Panel of the Romanian Handball Federation.
He is also involved in several projects at regional level, and he is currently the Secretary General of Proteus – an international network of law firms. Dan has become a member of REX Sport, an association of sport law practitioners since 2022. He is also an active member of NRCC (Netherlands-Romanian Chamber of Commerce), Belgian and Hellenic Chambers of Commerce, and member of Legal Mondo Network.
Dan is a member of the Bucharest Bar Association.
Şerban PÂSLARU este Partener al Ţuca Zbârcea & Asociaţii şi coordonator al departamentului de Dreptul Muncii. El deţine o experienţă de 21 ani în consilierea angajatorilor în probleme specifice de dreptul muncii, incluzând pregătirea documentaţiei aferente încetării raporturilor de muncă şi parcurgerea etapelor procedurilor de restructurare, negocieri colective, pregătirea şi implementarea planurilor de concedieri, efectuarea transferurilor de întreprindere, pregătirea şi implementarea unor programe motivaţionale, asistență pe durata conflictelor de muncă etc.
Şerban Pâslaru este membru al unor prestigioase asociații profesionale precum HR Club, European Employment Lawyers’ Association (EELA) și face parte din comitetul privind dreptul muncii al Multilaw. Șerban Pâslaru participă frecvent, în calitate de lector, la conferințe, seminarii și mese rotunde pe teme de legislația muncii și este autorul mai multor articole și analize de drept publicate în reviste interne și internaționale.
